Welcome to Sameness Cloud. These Terms of Service ("Terms") govern your access to and use of the Sameness Cloud platform, website, and related services (collectively, the "Services"). By using our Services, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using Sameness Cloud, you agree to these Terms. If you do not agree to all the terms and conditions, you may not access or use the Services.

2. Description of Service

Sameness Cloud is an AI-native brand guidelines platform that allows users to define, store, and export brand guidelines in formats optimized for both human and AI consumption (including MCP Server endpoints, brand.json manifests, and design tokens).

3. User Accounts

To use certain features of the Services, you must register for an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4. Subscription and Payment

Sameness Cloud is offered as a subscription service. By subscribing, you agree to pay the applicable fees (e.g., $39/month). Fees are non-refundable except as required by law. We reserve the right to change our pricing upon notice to you.

5. User Content and Brand Data

You retain all rights to the brand guidelines, assets, and data you upload or create using Sameness Cloud ("User Content"). By using the Services, you grant Sameness Cloud a license to host, store, and process your User Content solely for the purpose of providing the Services to you.

6. Acceptable Use

You agree not to use the Services to:

  • Violate any laws or regulations.

  • Infringe on the intellectual property rights of others.

  • Distribute malware or engage in malicious activities.

  • Interfere with or disrupt the integrity or performance of the Services.

7. Third-Party Provider Terms

Sameness Cloud products and services may include data, information, software, or other services provided by third parties. Some third-party providers require us to pass additional terms through to you. Your use of our products and services constitutes your agreement to be bound by these third-party terms.

Subprocessors

The following is a list of subprocessors that Sameness Cloud uses to provide our products and services. Subprocessors are third-party service providers that may process data on our behalf.(Note: This list will be updated as we finalize our infrastructure partners prior to launch.)

8. AI Integrations and Usage

Sameness Cloud provides endpoints (such as MCP Server and brand.json) designed to be queried by third-party AI systems (e.g., Claude, OpenAI). We are not responsible for the outputs generated by these third-party AI systems using your brand data.

9. Termination

We may terminate or suspend your access to the Services at any time, without prior notice or liability, for any reason, including if you breach these Terms.

10. Disclaimer of Warranties

The Services are provided "as is" and "as available" without warranties of any kind, either express or implied.

11. Limitation of Liability

In no event shall Sameness Cloud be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Services.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page. Your continued use of the Services after any such changes constitutes your acceptance of the new Terms.
